1. Scope
These Terms of Service govern your access to and use of the Display Manager website, account services, checkout flows, and related software-license management features provided by Display Manager, operated by David Julian Spiess. By using the service, creating an account, or buying a license, you agree to these Terms, our Privacy Policy, our Cookie Notice, and our Refund Policy.
2. Eligibility and account security
- You must be legally capable of entering into a binding contract in your location.
- You must provide accurate sign-in and billing information and keep it current.
- You are responsible for activity under your account and for keeping credentials, session tokens, and device approval codes confidential.
- You must notify us promptly if you suspect unauthorized access or credential compromise.
3. Orders, pricing, and taxes
- Prices, package sizes, product descriptions, and feature limits may change before purchase.
- Unless expressly stated otherwise, prices may exclude taxes, duties, bank charges, or foreign-exchange fees that your payment provider or local law may require.
- We may reject or cancel an order if pricing, configuration, fraud, technical, or fulfillment issues affect the transaction. If payment has already been captured in error, we will refund the affected amount.
4. Digital delivery and EU consumer withdrawal rights
Display Manager licenses are digital products delivered electronically after successful payment and fulfillment.
- For EU/EEA/UK consumers, distance purchases may normally include a 14-day withdrawal right.
- Because the product is digital content supplied without a tangible medium and performance begins promptly after payment, checkout requires your prior request for immediate performance and your acknowledgement that, once delivery begins, the withdrawal right is lost to the extent permitted by law.

5. License grant and restrictions
Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable right to use the purchased software and related entitlement features for your internal personal or business use.
- You may not sell, sublicense, rent, lease, or publicly redistribute the service except where we expressly permit it in writing.
- You may not bypass licensing controls, seat limits, device binding rules, or security protections.
- You may not use the service in a way that violates our Acceptable Use Policy.
- Open-source or third-party components remain subject to their own applicable license terms.
6. Compatibility and service changes
- Monitor-control functionality depends on hardware, drivers, operating systems, connection methods, DDC/CI behavior, and related third-party environments that we do not control.
- We do not guarantee compatibility with every monitor, dock, operating system, display chain, or enterprise environment.
- We may improve, modify, suspend, or discontinue features where reasonably necessary for security, compliance, maintenance, or product evolution.
7. Third-party services
Parts of the service depend on third-party providers, such as payment processors and optional OAuth providers. Your use of those third-party services may also be subject to their own terms and privacy practices. We are not responsible for third-party services outside our reasonable control.
8. Intellectual property
The service, website, text, graphics, branding, product design, and related software are protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, all rights are reserved.
9. Warranties and mandatory consumer rights
To the maximum extent permitted by law, the service is provided on an “as is” and “as available” basis. We do not promise uninterrupted availability or error-free operation. Nothing in these Terms limits any non-waivable statutory rights, legal guarantees, or consumer protections that apply to you under mandatory law.
10. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business interruption.
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the service will not exceed the greater of the amount you paid us for the affected service in the 12 months before the event giving rise to the claim or EUR 100.
This limitation does not apply where liability cannot be limited by law, including for fraud, intentional misconduct, gross negligence where non-excludable, death or personal injury caused by negligence, or violation of non-waivable consumer rights.
11. Suspension and termination
We may suspend or restrict access where reasonably necessary to investigate abuse, enforce these Terms, protect users, comply with law, or address security and operational issues. You may stop using the service at any time. License entitlements already delivered remain subject to the purchase terms and applicable law.

If mandatory law in your country gives you stronger rights than these Terms, those mandatory rights control to the extent of the conflict.
